CA No. 1095 of 2018 [Mohammad Imran vs. Province of Sindh & Others] [Supreme Court of Pakistan]
Through its order dated 13.12.2018 the Honorable Supreme Court of Pakistan was pleased to direct; firstly that all private schools charging a fee above PKR 5000/- will be subject to a blanket one time reduction of 20%. Secondly, that all private schools must limit any fee increase in the future to the legal maximum, that is 5%-8%. If any fee increase is proposed between 6%-8%, the said fee increase must be approved by the Regulator. Thirdly, the said private schools will be required to return half of the summer fees charged in the previous year. Fourthly, the Honorable Supreme Court took note of the Auditor General’s report on record and ordered an inquiry into the accounts of the listed private schools for the past five years and appointed the Federal Investigative Agency(FIA) to assist and take said schools’ ledgers into custody.
Through its Order dated 10.01.2019, the Honorable Supreme Court of Pakistan made clarifications and provided further guidance as to the implementation of its previous Order dated: 13.12.2018. The august Court also took note of those private schools disrespecting the law of the land by violating the apex Court’s Orders; and disrespecting the students as well as their parents; and disrespecting the worthy task of providing quality education.
Through its Order dated 11.02.19, the Honourable Supreme Court of Pakistan has issued directions to the concerned heads of the private schools to file their respective replies in light of the previous Order of the Honourable Court and to clarify their conduct towards the students and their parents, as well as, to state the implementation of the judgement of the Honourable Court in letter and spirit.
The Honourable Supreme Court of Pakistan was pleased to hear this case for final arguments on a day to day basis during the week of 9th April, 2019 and during the week of 6th May, 2019. The Honourable Judge of Supreme Court passed the final judgement on 09.05.2019.
